RideHike Terms of Service

Welcome to RideHike! These Terms of Service ("Terms") govern your use of the RideHike application ("App") and the services provided by RideHike ("Services"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the App.
1. Introduction
RideHike is an innovative application designed to facilitate the seamless matching, operation, and transactions associated with ride-sharing for commuters and carpoolers. Our platform serves as a bridge, connecting individuals who are seeking to share rides ("Hikers") with those who are offering rides ("Drivers").
2. Services Provided by RideHike
RideHike offers a variety of services to enhance the ride-sharing experience, including but not limited to:
- Connection Platform: We provide a user-friendly platform that enables Hikers and Drivers to connect and coordinate their carpools effectively.
- Communication Support: Our App facilitates direct communication between Hikers and Drivers, ensuring that both parties can easily exchange information and updates regarding their rides.
- Agreement Brokering: We assist in brokering agreements between Hikers and Drivers, helping to establish clear expectations and arrangements for each ride.
- Reminders and Tracking: To keep all parties informed and engaged, we offer features that provide reminders and real-time tracking during commutes, ensuring that everyone is updated on the status of ongoing rides.
3. Limitations of RideHike's Responsibilities
While we strive to provide a reliable and efficient platform, it is important to note that RideHike does NOT do:
- Safety Responsibility: RideHike does not assume any responsibility for the safety of the individuals involved in the ride-sharing process. It is the sole responsibility of both Hikers and Drivers to prioritize their own safety at all times.
- Employment: RideHike does not act as an employer for any of the parties involved, including both Drivers and Hikers. Our role is strictly that of a facilitator.
- Legal Ownership: RideHike does not assume legal ownership or responsibility for the outcomes of any commute arranged through our App. The responsibility for the ride lies solely with the individuals participating in it.
4. Safety Features
At RideHike, we are deeply committed to the safety and well-being of our users. To this end, we have implemented a panic feature designed to provide instant visibility in situations where you may feel unsafe. However, it is essential to understand that this feature does not guarantee safety and should not be relied upon as a substitute for standard safety practices.
5. User Responsibilities
As a user of the RideHike App, you agree to adhere to the following responsibilities:
- Provide Accurate Information: You are required to always provide accurate, truthful, and up-to-date information when requested by the App.
- Age Requirement: You must be at least 18 years of age to use the App and its services.
- Respect Others: You are expected to protect and respect the rights and safety of those around you, fostering a positive environment for all users.
6. Prohibited Activities
You agree to refrain from engaging in the following prohibited activities while using the RideHike App:
- Fraudulent Behavior: You must not attempt to manipulate or exploit the system in any way, including but not limited to creating multiple accounts or attempting to launder money through the platform.
- Legal Violations: You are prohibited from breaking any laws, including traffic regulations and other applicable legal requirements.
- Intellectual Property Theft: You must not attempt to steal any intellectual property or personal data belonging to other users, including activities such as crawling or scraping.
- Account Compromise: You must not willfully compromise the security of any account, including your own or that of other users.
7. What RideHike Is Not
It is important to clarify that RideHike is not:
- A transportation network company, and we do not operate as such.
- A romantic "matchmaking" app. While we acknowledge that love can blossom in unexpected places, our primary focus is on facilitating ride-sharing.
8. Dispute Resolution
In the event of any disputes arising from your use of the App, you agree to first engage in informal negotiations to seek a resolution. If a satisfactory resolution cannot be reached, you agree to submit the dispute to binding arbitration, which will be held in Volusia County, Florida. If, for any reason, it is not possible to conduct arbitration in Volusia County, RideHike retains the right to designate an alternative location for the arbitration proceedings. RideHike shall have the sole discretion to select the arbitration association that will govern such proceedings.
9. Limitation of Liability
To the fullest extent permitted by law, RideHike shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the RideHike App or Services. This includes, but is not limited to, any accidents, injuries, losses, or damages incurred by users while using the App, participating in ride-sharing arrangements, or engaging with other users.
You acknowledge and agree that RideHike is not responsible for the actions or omissions of any users, including Drivers and Hikers, and that any interactions or transactions between users are conducted at their own risk. RideHike does not guarantee the safety, reliability, or quality of any rides arranged through the App.
By using the RideHike App, you agree to indemnify, defend, and hold harmless RideHike, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your interactions with other users, or any violation of these Terms.
This limitation of liability applies to the maximum extent permitted by applicable law and shall survive the termination of your use of the RideHike App.
10. Changes to Terms
RideHike reserves the right to modify these Terms at any time. We will notify users of any changes by posting the updated Terms on the App. Your continued use of the App following any changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically to stay informed about any updates.

12. User-Submitted Content
By submitting, uploading, or otherwise providing any content to the RideHike App, including but not limited to text, images, videos, feedback, or any other materials (collectively referred to as "User Content"), you grant RideHike a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.
You represent and warrant that:
- You own or have the necessary rights to the User Content you submit, and you have the right to grant the license granted above.
- The User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
- The User Content complies with all applicable laws and regulations.
RideHike reserves the right to review, edit, or remove any User Content at our sole discretion, without notice, for any reason, including but not limited to violations of these Terms or any applicable laws.
By submitting User Content, you acknowledge that you are solely responsible for the content you provide and that RideHike is not responsible for any User Content that you or any other user submits. You agree to indemnify and hold harmless RideHike from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with any User Content you submit.
13. Third-Party Links and Services
The RideHike App may contain links to third-party websites, applications, or services that are not owned or controlled by RideHike. These links are provided for your convenience and informational purposes only. RideHike does not endorse or assume any responsibility for the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that RideHike is not responsible or liable for any damages or losses caused or alleged to be caused by or in connection with your use of or reliance on any such third-party websites, applications, or services. Any interactions you have with third parties, including but not limited to transactions, communications, or agreements, are solely between you and the third party.
We encourage you to review the terms of service and privacy policies of any third-party websites or services you visit. Your use of third-party links and services is at your own risk, and you are solely responsible for any consequences that may arise from such use.
14. Transactions and Fees
All payments made by Hikers to Drivers will be processed through RideHike. Upon receipt of payment, RideHike will deduct the applicable fees and subsequently disburse the remaining funds to the Drivers. By using the RideHike App, you acknowledge and agree to this payment processing structure.
Drivers and Hikers have the ability to set their own costs for rides within reasonable boundaries established by RideHike. This is to ensure compliance with applicable laws and to prevent illegal activities, including but not limited to money laundering. RideHike reserves the right to review and adjust any ride costs that are deemed excessive or inappropriate.
In the event that a user has any outstanding balances or costs incurred through the use of the App, RideHike reserves the right to apply any payments received to settle those outstanding amounts before disbursing funds to the user.
By participating in transactions through the RideHike App, you agree to comply with all applicable laws and regulations regarding payments and transactions, and you acknowledge that RideHike is not responsible for any disputes arising from the financial arrangements between Drivers and Hikers.
Section 14A. Procedures for Resolving Transaction-Related Disputes

Notification of Error
- If a user identifies an issue with a payment or transaction – including errors, unauthorized transactions, or discrepancies – the user must notify RideHike by email at support@ridehike.app or through any other designated communication channel. Notification must be provided within 60 days after the statement first reflecting the alleged error is received.
- In cases where the error is identified orally, RideHike will begin its investigation immediately. The user is encouraged to follow up with a written notice within 10 business days.

Investigation Process and Timelines
- Upon receipt of a notice of error (either written or oral), RideHike promptly initiates an investigation. An initial review is completed within 10 business days of receiving the error notice.
- RideHike completes its full investigation within 45 calendar days from the date the error is first reported. If further time is required—due to pending documentation or coordination with third parties—the user is promptly informed with an updated estimated completion date.

Provisional Credits
- If a user provides timely notice of a transaction error, RideHike provisionally credits the user’s account for the disputed amount within 10 business days pending completion of the investigation, in compliance with Regulation E.
- If the investigation concludes that no error occurred, or that an error occurred in a different amount, RideHike notifies the user in writing, and if necessary, debits the provisional credit. Any such debit occurs no later than five business days following notification.

Interim Measures and Final Determination
- During the investigation, RideHike may take interim measures – including temporarily holding or adjusting funds related to the disputed transaction – to ensure fairness to all parties.
- Upon completion of the investigation, RideHike provides the user with written notification detailing the outcome.
- If the investigation ultimately supports the user’s claim, any provisional credits are made permanent; otherwise, an explanation detailing the findings is provided along with any necessary adjustments to the user’s account, as described in subsection (c).

Documentation and Recordkeeping
- RideHike maintains detailed records of all transactions and investigations related to dispute resolution, which may be provided to the user upon a reasonable request in the interest of transparency.
- Where information or documentation is held by a third party and is required to resolve a dispute, RideHike advises the user promptly and makes all reasonable efforts to obtain the necessary documentation.
15. Relationship with App Stores
RideHike is made available to users through various app stores, including but not limited to the Google Play Store and the Apple App Store (collectively referred to as "App Stores"). By downloading and using the RideHike App, you acknowledge and agree to the following:
- Third-Party Platforms: RideHike is not affiliated with, endorsed by, or responsible for the App Stores. The availability of the RideHike App on these platforms does not imply any endorsement or partnership between RideHike and the App Stores.
- Compliance with App Store Policies: Your use of the RideHike App is subject to the terms and conditions of the respective App Store from which you downloaded the App. You agree to comply with all applicable policies and guidelines set forth by the App Stores.
- Limitations of Liability: RideHike shall not be liable for any issues, damages, or losses arising from your use of the App Stores or any third-party applications. Any concerns or disputes related to the App Stores should be directed to the respective platform.
By using the RideHike App, you acknowledge that you have read and understood this section regarding the relationship between RideHike and the App Stores, and you agree to abide by the terms and conditions set forth by both RideHike and the App Stores.
16. Electronic Communication (eSign) Agreement & Disclosure
By signing up to use our services, you acknowledge and accept our Terms of Service and Privacy Policy. Your acceptance of these terms is considered an electronic signature, confirming your agreement to abide by them. This electronic signature will be securely retained in accordance with our data retention policies for purposes such as confirming your acceptance and for potential dispute situations.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located within Florida for the resolution of any disputes arising from or related to these Terms or your use of the RideHike App.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the extent necessary to make it valid and enforceable.
19. Entire Agreement
These Terms constitute the entire agreement between you and RideHike regarding your use of the App and Services, superseding any prior agreements between you and RideHike.
